using this website you are fully accepting the disclaimers, terms and conditions
used in this notice. You must stop using this website immediately if you
disagree with any of the terms and conditions stated.
Whilst we attempt to make sure that the information on this website is correct,
we accept no liability of any kind for any loss or damage from action taken in
reliance on material or information contained on this site. In addition, whilst
we try to make sure that all prices on our website are correct, inaccuracies,
errors or omissions may happen. If we discover an error in the price or an
inaccuracy in the description of the goods you have ordered we will inform you
as soon as possible and give you the opportunity of re-approving your order at
the correct price or cancelling it. You will receive a full refund if you have
paid for the goods and subsequently decide to cancel.
On some occasions we may have to refuse your, we reserve the right to do so, and

Your credit/debit card details will be encrypted by Thwate, a secure server,
certified to accept credit card payments online to minimise the possibility of
unauthorised access or disclosure, making your details safe and secure.
All major credit/debit cards are accepted for payment, this is a secure website.
Every time you enter an area of the site that has or requires sensitive
information such as credit card details, an icon at the bottom of your browser
window will appear which will resemble a closed padlock or an unbroken key. We
use Internet standard SSL encryption technology to scramble your sensitive data
when you transmit it to us. All collected information is stored on our secure
systems, and credit card numbers are wiped from our computer database following
payment.
The confirmation stage sets out the final details of your order. When you submit
this we will then send an email with your order acknowledgement which details
what you have ordered, please note that this does not constitute an acceptance
of your order from us.
Authority for payment must be given at the time of order. If there is a problem
taking payment for all or part of your order we will contact you by email or by
telephone.
The price of an item does not include the delivery charge, which will depend on
the delivery method you choose. The rate applicable for the delivery charge will
be calculated at the date you place your order. For more information on delivery

In the case of goods that are made to order such as beds or mattresses, your
acceptance of the order takes place at the point at which we confirm our
acceptance of your order please note that different cancellation rights apply to
made to order products. Once these products have been delivered they can not be
returned unless they are damaged or have been mis-described, this does not
affect your statutory rights.
Delivery
Delivery will be made to the address specified when you complete the order and a
final delivery charge will be confirmed before your order is processed.
Please note we only deliver to addresses within mainland England, Scotland and
Wales, excluding the highlands and islands. Additional charges may be applicable
to more remote areas and you will be notified of this either by phone or email.
If an item is temporarily unavailable or has a longer lead-time, then you will
be contacted with the choice of an alternative or a revised delivery date.
We use a variety of delivery methods, depending on the size of the item you
order and the speed with which you wish to receive it. For more information on
delivery arrangements and prices see delivery information. Whilst we make every
effort to deliver most items within 30 days of the date of your order, we shall
not be liable if we fail to do so in part or in full due to circumstances beyond
our control. We can not be liable for any loss of wages or any costs either
directly or indirectly which result in a delay in delivery. We will contact you
to let you know if we are having any problems getting an item to you.
A signature is required at delivery. By placing an order you are authorising us
to accept a signature from another person on your behalf if you are not present
at the time of delivery. Ownership of an item will not pass to you until we have
delivered the item to you. When an item is delivered, risk of damage to or loss
of the item passes to you.
We reserve the right to charge a re-delivery fee to cover delivery costs if
there is no one present on the agreed delivery date.
We have no facility for the collection and disposal of your old bed or mattress
however we advise you to only dispose of your old goods following the acceptance
of delivery of your new goods
In exceptional circumstances, a product may arrive suffering minor wear and tear
from the shipping process, or even a minor defect that occurred at the factory.
It is important that you report any damage immediately upon delivery by noting
it on the Delivery paperwork and emailing us on [email protected] or
calling our customer services department on 0870 8503095
It is your responsibility to ensure there is adequate space at the delivery
address for the delivery to take place, please check the measurements of the
goods you are buying. If we can not make delivery as the space is too restricted
or it is impossible to make the delivery to due health and safety requirements
then we will consider this to be a failed delivery. You will agree to pay our
additional fees for rearranging delivery on your behalf and also for the storage
of goods until this arrangement can be made. You will at this point have the
choice of rearranging the delivery of your goods including the additional costs
of re-delivery and storage. This extra cost will only be charged at the cost
charged to us by the delivery company. If at this point you decide to cancel
your order we will refund the cost of your goods less the delivery fee. In the
case of made to order beds and mattresses these can not be cancelled and an
arrangement for re-delivery including any extra costs we incur on your behalf
will be confirmed with yourself.
Our standard delivery is a one man delivery to your door only. If you live in a
flat or apartment delivery shall be made to the lobby of that block. Once
delivery has been made the ownership of title passes to you and we will not be
held responsible for loss or damage to the goods from that point.
Where delivery is being made by our 2 man gold star service we will use
reasonable attempts to deliver goods to your room of choice within the delivery
address, this is providing that it is safe and practical to do so, if the
delivery team reasonably consider that delivery to the room of your choice is
likely to cause damage to the goods or to your property, they will inform you
and record this concern on the delivery document. Once you are aware of these
factors you may still decide to go ahead with your delivery, we will not be
liable for any damage caused to the goods or your property as a result of an
attempted delivery on your instructions.
Returns
Should you wish to return products purchased online, you must notify us by
telephone or in writing within seven days of the receipt of your goods. We
accept returns of all items only if they are returned within 30 days of
delivery. You can either arrange to return the goods yourself at your own cost
or you may ask us to arrange to collect the goods on your behalf. You will be
charged £40 for this service and this will be deducted from your refund. Goods
must be returned to us in the same condition they were in at the time of
delivery and in their original packaging. Items which are not adequately
packaged at time of collection may not be collected and a charge of £40 may be
imposed to cover cost of failed collection. Refunds of the goods less the
delivery charge will be issued within 30 days of receipt of goods and after we
have inspected them for damage.
If the goods we have delivered are incorrect, we will organise collection and we
will replace the item free of charge as soon as possible.
If the goods are damaged; we will arrange collection and we will replace the item
free of charge as soon as possible.
We reserve the right to withhold all or part of your refund if items are
returned damaged.
Mattresses can only be returned if they are unopened. Mattresses which have been
opened and slept on cannot be returned. If you wish to test a mattress please
keep it wrapped until you are sure you want to keep it.
We will not accept the return of any item which has undergone any assembly by
the purchaser. All items returned to us must be in the original packaging and
returned in same condition as it was delivered.
Limitations
We will not be liable for any direct or indirect loss or damage arising under
these terms and conditions or in connection with our website. The total
liability of this agreement shall be limited to the price paid for the products.
These terms and conditions do not exclude our liability if any to you for
personal injury or death resulting from our negligence and do not affect your
statutory rights.
This website must not be used for any purpose that make be unlawful including
interfering with another person’ use of this website, making, transmitting or
storing copies of materials protected by copyright within this website without
permission of the owner. We will do our best to check the website for viruses
but we do not warrant that the website is free of viruses or other malicious
content. For your own benefit, you should make sure that you have appropriate
software and systems in place to check for viruses and other malicious content
on the internet.
If you access any other sites from links from our website we can not be held
responsible for the content on that site, these external sites our outside of
our control and not covered by these terms and conditions.
Not all goods and promotions that are offered online will be available in our
Stores, and this also applies in reverse. Generally, our online prices are the
same as in our stores. Occasionally, however, you may find a difference in
price, for instance where there are different store and online promotions. We
reserve the right to adjust prices, goods and special offers at our discretion.
All offers are subject to availability and while stocks last
Events beyond our reasonable control
To the fullest extent permitted by law we will not be held responsible for any
failure to provide or delay arising from any event which is beyond our
reasonable control. This includes but is not limited to any default due to an
act of God, fires, floods, earthquakes, storms, natural disasters, war, civil
unrest, act of terrorism or threatened terrorism, or malicious damage to our
premises, industrial disputes and individual action. This provision does not
affect your statutory rights.
Law and Jurisdiction
We will try to solve any disagreements quickly and efficiently, if you are not
happy with the way we handle any disagreement then this will be covered by
English law, and any disputes relating to this notice shall be subject to the
exclusive jurisdiction of the English courts.
